A class action has been commenced in the Federal Court of Australia against Virgin Australia Holdings Limited (Virgin Australia), two former directors of Virgin Australia, a related entity of Virgin Australia, and Virgin Australia’s insurers (together, the Respondents) by a company which purchased notes issued by Virgin Australia, Matheson Property Group Pty Ltd (as trustee for the MPG Trust) (MPG or the Applicant).
MPG is bringing a claim for itself. MPG is also bringing the claim on behalf other investors who purchased:
- unsecured Australian Dollar denominated notes that were issued by Virgin Australia on 26 November 2019 (AU Notes); and
- unsecured United States Dollar denominated notes that were issued by Virgin Australia on 7 November 2019 (US Notes).
The investors on whose behalf MPG makes claims are called Group Members. The case is known as the Virgin Notes Class Action.
